Terms of Service
These Terms are a binding agreement between you and Kaivos governing your use of the Kaivos website and SMS/iMessage-based AI mentorship service (the “Service”). By creating an account, starting a trial, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. What Kaivos is — and is not
Kaivos is an AI-powered motivational and accountability messaging service. Messages are generated by artificial intelligence, not a human. Kaivos is not a therapist, counselor, or medical, mental-health, legal, or financial advisor, and is not a crisis or emergency service. It is general motivational content for self-improvement only, and may be inaccurate — you use it at your own discretion and risk.
If you are experiencing a mental-health crisis or thoughts of self-harm, do not use the Service for help. In the U.S., call or text 988 (Suicide & Crisis Lifeline) or call 911.
2. Eligibility
You must be at least 18 years old and able to form a binding contract. If we learn a user is under 18, we will terminate the account and refund any unused fees.
3. Text messaging consent
By checking the SMS box at signup, you consent to receive recurring automated texts from Kaivos (daily mentorship, check-ins, reminders, and billing notices). Consent is not a condition of purchase. Message frequency varies; message and data rates may apply. Reply STOP at any time to stop all messages, or HELP for help. Stopping messages does not by itself cancel a paid subscription — see Section 4.
4. Subscriptions, free trial, and billing
The Service is an auto-renewing subscription: $79.99/year or $14.99/month, plus tax. New users may receive a 3-day free trial; a payment method is required to start it. Unless you cancel before the trial ends, your card is automatically charged the plan price on the date shown at checkout, and the subscription begins. It then renews automatically each period until you cancel. We send a reminder before the trial converts.
Cancel anytime, online, in one tap at kairos cancel or from your account — no phone call required. After cancellation you keep access through the period already paid. Except where required by law, payments are final and non-refundable; we may offer refunds or plan changes at our discretion.
5. Your content & privacy
You own the messages you send. You grant us a license to use them to operate, personalize, secure, and improve the Service (including its memory features). We do not sell your content. SMS is not end-to-end encrypted through all carriers — do not send sensitive financial or health information through the Service.
6. Health & activity disclaimer
Kaivos may suggest activities such as exercise or schedule changes. Consult a physician before beginning any exercise or significant lifestyle change. You assume all risk of activities you choose to undertake.
7. Disclaimers & limitation of liability
The Service is provided “as is,” without warranties of any kind. We do not warrant any particular result. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the prior 12 months or $100, and we are not liable for indirect or consequential damages.
